Upload Policy

Rules and requirements for uploading content to our platform.

Introduction

This Upload Policy sets out the rules, requirements, and procedures that apply to all Creators when uploading Content or offering Products on the Fannilla™ platform (the Platform). This policy forms part of, and should be read together with, the Terms of Service, Acceptable Use Policy, and Purchase & License Agreement.

By uploading any Content to the Platform, you confirm that you have read, understood, and agree to comply with this Upload Policy in full.

Pre-Upload Requirements

Before uploading any Content, you must confirm and be able to demonstrate each of the following.

2.1 Age Verification

You are at least 18 years of age (or the minimum legal age in your jurisdiction, whichever is higher).
All individuals depicted in your Content are at least 18 years of age at the time the Content was created.
You have verified the age of each depicted individual by inspecting a valid government-issued photo ID (e.g. passport, national ID, driver's license).
You retain copies of the relevant identification documentation and will provide these to Fannilla™ upon request.

2.2 Consent

You have obtained the explicit, informed, and freely given consent of every individual who is depicted in or identifiable from the Content.
Consent covers both (i) being depicted in the Content, and (ii) the public distribution of that Content on the Platform.
You hold written documentation evidencing such consent and will provide it to Fannilla™upon request.
Consent can be withdrawn. If a depicted individual withdraws their consent after upload, you must notify Fannilla™ immediately at abuse@fannilla.com .

2.3 Ownership and Intellectual Property

You are the sole and exclusive owner of all rights in the Content you upload, or you hold all necessary licenses, consents, and waivers to upload and distribute that Content on the Platform.
Your Content does not infringe any third-party intellectual property rights, including but not limited to copyrights, trademarks, or rights of publicity.
You may not upload Content created by, or featuring the intellectual property of, a third party without their explicit written authorization.

2.4 Compliance with 18 U.S.C. § 2257

Where applicable, you certify compliance with the record-keeping requirements under 18 U.S.C. § 2257 and 28 C.F.R. Part 75 for all uploaded Content depicting sexually explicit conduct.
You agree to make such records available for inspection upon lawful request.
Note: This requirement applies primarily to Creators who are subject to US jurisdiction. Non-US Creators are encouraged to maintain equivalent records in accordance with their local laws.

2.5 Pre-Upload Declaration

At the point of upload, you will be required to confirm the following declarations. This is a mandatory step and cannot be bypassed:

I confirm that all individuals depicted in this Content are at least 18 years of age and have provided their explicit consent.
I confirm that I own the rights to this Content or hold all necessary authorizations to distribute it.
I confirm that this Content complies with the Fannilla™ Terms of Service, Acceptable Use Policy, and all applicable laws.
I confirm that this Content does not depict or promote illegal activity, non-consensual acts, violence, or harm.

Technical Upload Specifications

All uploads must meet the following technical requirements. Content that does not meet these requirements may be rejected automatically or held for manual review.

3.1 File Size and Quantity Limits

Maximum file size per upload session: 20 GB.
Maximum number of photos per upload: 100.
Maximum number of videos per upload: 4.
Maximum number of audio files per upload: 4.
There is no fixed maximum duration for video or audio files, subject to the 20 GB per session limit.
Uploads that exceed these limits will be automatically rejected.

3.2 Accepted File Formats

3.3 General Quality Standards

Content must be accurately described at the time of upload. Misleading titles, descriptions, or thumbnails are not permitted.
Content must be in good technical quality. Corrupted, unintelligible, or severely degraded files will be rejected.
Thumbnails must accurately represent the Content.

Content Standards at Upload

All Content uploaded to Fannilla™ must comply with the following standards. These requirements apply at the point of upload and remain in force for as long as the Content is hosted on the Platform.

4.1 Permitted Content

Adult content (nudity and sexually explicit material) involving verified adult individuals who have given explicit consent.
Creative, artistic, and editorial content consistent with the Terms of Service.
Advertising Content, provided it is correctly marked as an advertisement at the point of upload and complies with Article 12 of the Terms of Service.

4.2 Prohibited Content

The following categories of Content are strictly prohibited and will never be permitted on the Platform:

A. Minors

Any Content depicting individuals under the age of 18, including simulated, animated, or AI-generated depictions.
Any Content that sexualizes or endangers minors in any form.

B. Non-Consensual Content

Content depicting or implying non-consensual sexual activity.
Recordings, images, or clips made without the knowledge or consent of depicted individuals, including hidden camera footage.
Deepfakes or synthetic media depicting real individuals in sexual situations without their verified consent.

C. Violence and Harm

Content depicting real or simulated violence, injury, or physical harm to persons or animals.
Content that promotes, encourages, or facilitates self-harm, suicide, or eating disorders.

D. Illegal Activity

Content related to or promoting prostitution, sex trafficking, or escort services.
Content involving controlled substances, illegal drugs, or dangerous activities.
Content that violates applicable laws or regulations in any jurisdiction.

E. Hate Speech and Discrimination

Content that promotes hatred, discrimination, or violence based on race, ethnicity, nationality, religion, gender, sexual orientation, disability, or other protected characteristics.

F. Privacy Violations

Content that reveals personal information of an individual without their consent.
Content featuring recognizable individuals who have not provided verified consent.

G. Synthetic and AI-Generated Content

AI-generated or synthetic Content depicting real, identifiable individuals without their explicit consent.
Deepfakes or manipulated media that could mislead viewers or harm the depicted individual.
AI-generated Content depicting minors in any sexual or suggestive context.

H. Misinformation

Content that spreads demonstrably false information likely to cause harm or public confusion.

Collaboration Content

If your Content features another person (a Collaboration), additional requirements apply in addition to those set out in Section 2 above. You must comply with Article 11 of the Terms of Service in full.

All individuals depicted in a Collaboration must be verified as being at least 18 years of age.
Written consent must be obtained from each depicted individual prior to upload.
Where the Collaboration involves another Fannilla™ Creator, you must tag the relevant Creator at the point of upload. The Collaboration will only be published once the tagged Creator has accepted.
Creator Earnings from Collaboration Content will be evenly split between all participating Creators, as specified in the Terms of Service.

Screening and Review Process

All Content uploaded to Fannilla™ is subject to a pre-publication screening process before it becomes visible to Fans.

6.1 Automated Screening

Upon upload, Content is automatically screened using AI-assisted detection tools to identify potential violations of this Policy and the Acceptable Use Policy.

Content that passes automated screening may be published immediately or held for further review, at Fannilla™'s discretion.

6.2 Human Review

Content flagged by automated tools, or that falls into categories requiring additional scrutiny, will be escalated to human reviewers.

Content in a “pending review” status will not be visible to other users until the review is complete.

Fannilla™ aims to complete human review within 2 business days. You will be notified of the outcome.

6.3 Post-Publication Review

Fannilla™ may also review Content after it has been published, for example following a user report, complaint, or detection signal.

Content found to be in violation after publication will be removed and you will be notified in accordance with the Notice & Action Policy.

Metadata and Labelling

You must accurately categorize and describe your Content at the point of upload.
Advertising Content must be explicitly marked as an advertisement at the point of upload. You will be asked to confirm this before submission.
Providing false, misleading, or inaccurate metadata (including titles, descriptions, categories, or tags) is a violation of this Policy.

Consequences of Violations

Uploads that violate this Policy may result in one or more of the following consequences, as determined by Fannilla™ in its sole discretion and in accordance with the Acceptable Use Policy and the Terms of Service:

Immediate rejection or removal of the Content without prior notice.
Temporary suspension of your uploading privileges or account.
Permanent termination of your account.
Suspension or forfeiture of Creator Earnings associated with violating Content.
Referral to the relevant authorities, including law enforcement, where required by applicable law.

Note: Fannilla™ is legally required to report certain types of content (including child sexual abuse material) to the relevant national and international authorities, regardless of account status or earnings.

Reporting Violations

If you encounter Content on the Platform that you believe violates this Policy or applicable law, please report it immediately:

Changes to this Policy

Fannilla™ reserves the right to update or amend this Upload Policy at any time. We will notify you of material changes via the Platform or by email. Continued use of the Platform following notification of changes constitutes your acceptance of the revised policy.
